Together with our Terms of Use, Cookie Policy, and this Privacy Policy, it constitutes the content of our agreement with you (User Agreement).

2.1. Terms used

“Personal Data”

This means any information relating to an identified or identifiable natural person (hereinafter referred to as the “data subject”). “Processing”
Means any operation or set of operations which is performed on personal data or sets of personal data, whether or not by automated means. The term is broad and includes virtually any handling of data.

“Data Controller”
Means the natural or legal person or public authority or institution which alone or jointly with others determines the purposes and means of the processing of personal data.

 

2.2. Relevant Legal Bases
eGamingUp reserves the right, at our discretion, to change, add, delete, or modify portions of this Privacy Policy. Please review these terms and conditions periodically for any changes. Your continued use of our sites following the posting of modifications to these terms of use constitutes acceptance of those changes.

3.1. Collaboration with Processors and Third Parties

If, in the course of our processing, we disclose data to other individuals and companies (contract processors or third parties), transmit them, or otherwise grant access to the data, this is done exclusively with legal permission granted by eGamingUp. By accepting the User Agreement, you have given your consent for the transmission, as required by law or based on our legitimate interests (e.g., use of agents, web hosts, partners, etc.). Please note that eGamingUp may take actions in its interests and collaborate with cooperation partners. In such cases, the transfer of your data to the respective cooperation partner is required for the implementation and execution of such actions. If you register with eGamingUp, you may be required to enter into a separate contract between yourself, the partner, and us, as determined by eGamingUp. In addition to our data protection provisions, the respective privacy policy of the partner also applies in this case. The privacy policy of the partner may differ in individual cases from ours. By registering an account, you agree to the privacy policy of eGamingUp’s partners. In this case, we are not responsible for the data processing carried out by the partner. Data required as determined by eGamingUp will be stored with us and transmitted to our partner for the joint execution of agreements, arrangements, and contracts of eGamingUp.

3.2. Transfer to Third Countries
If we process data in a third country (outside of the US), or if this is done in the context of using third-party services or disclosing/transmitting data to third parties, this is done only if our contractual obligations are met, based on your consent upon registering an account with us, based on a legal obligation, or based on our legitimate interests. Subject to legal or contractual requirements, we process or will process the data in a third country.

4. Your Rights
You have the right to request confirmation as to whether your data is being processed. You have the right to obtain information about this data. You have the right to receive a copy of the data. You have the right to demand the completion of data concerning you or the correction of incorrect data concerning you. You have the right to demand the deletion of relevant data or to demand a restriction on the processing of your data, which will lead us to decide, according to our legitimate interests, to take action on your registered account. 5. Cookies
“Cookies” are small files that are stored on users’ devices. Different information can be stored within cookies. A cookie is primarily used to store information about a user (or the device on which the cookie is stored) during or after their visit to an online service. Temporary cookies, or “session cookies” or “transient cookies,” are cookies that are deleted after a user leaves an online service and closes their browser. 6. Data Deletion
The data processed by us are deleted or restricted in its processing by our legitimate interests. Unless explicitly stated in this privacy policy, the data stored by us is deleted as soon as it is no longer necessary for our purposes and the deletion does not conflict with any legal storage requirements. Unless the data is deleted because it is necessary for other legitimate purposes, its processing will be restricted. This means that the data is blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax reasons. Storage is carried out without a specific time limit or by the legal requirements in Mexico (e.g., in commercial books, inventories, opening balances, annual accounts, commercial letters, accounting documents, books, records, management reports, accounting documents, commercial and business letters, and relevant tax documents, etc.).

8. Hosting

The hosting services we use serve the purpose of providing the following services:
Infrastructure and platform services, computing capacity, storage and database services, security services, and technical maintenance services that we use to operate our online services. Here, we or our hosting provider process inventory data, contact data, content data, contract data, usage data, metadata, and communication data of customers, stakeholders, and visitors to this online offering based on our legitimate interests (Data Processing Agreement).

9. Collection of Access Data and Log Files
We, or our hosting provider, collect access data each time the server on which our services are located is accessed (so-called server log files) based on our legitimate interests. Access data includes the name of the retrieved web page, the file, the date and time of retrieval, the amount of data transferred, the message about the successful retrieval, the type and version of the browser, the user’s operating system, the referrer URL (the previously visited page), the IP address, and the requesting provider. The log file information is stored for security purposes (e.g., to investigate abusive or fraudulent activities) and, in the event of an incident, may be retained for evidentiary purposes until the final resolution of the incident.

10. Provision of Contractual Services
We process inventory data (e.g., names and addresses) and contact information of users, as well as contract data (e.g., services used, contact names, payment information) to fulfill our contractual obligations and provide services accordingly. Entries in online forms, web pages, apps, and eGamingUp, in general, are occasionally necessary for the conclusion of contracts and may continue beyond the expiration of the legal warranty and comparable obligations. The need for data storage is verified at various intervals based on our legitimate interests. In the case of data required for legal obligations, deletion may occur after the expiration of such obligations.

11. Contact
When you contact us (e.g., through a contact form, email, or social media), your data for processing the contact request and the information provided may be stored in a Customer Relationship Management system (“CRM system”) or software with comparable functions. We delete contact requests when they are no longer necessary and assess the need for retention at intervals based on our legitimate interests.

12. Comments and Posts
If you leave comments or other contributions, your IP address will be stored based on our legitimate interests. This is for our security, as we may be held responsible for any illegal content in comments or contributions (e.g., insults, prohibited political propaganda, etc.). In such cases, we may report the content to the authorities or cooperate with them by legal requirements, and therefore, we have an interest in the identity of the author.

13. Newsletter by Email
We would like to inform you about the content of our newsletter, as well as the registration, sending, and statistical evaluation procedures, as well as your right to object. By subscribing to our newsletter, you agree to receive it and the procedure described below:

Consent to receive the newsletter: We only send newsletters with the consent of the recipient or legal permission granted for registration. The specific description of the newsletter content is decisive for your consent. By the way, our newsletter contains information about our services and us.

Double opt-in and log in: Registration for our newsletter is done through a so-called double opt-in procedure. After registration, you will receive an email asking you to confirm your registration. This is necessary to prevent anyone from signing up with someone else’s email address. The registration for the newsletter will be recorded to test the registration process by legal requirements. This includes, for example, the storage of your registration and confirmation time, as well as your IP address. Similarly, a change in your stored data is recorded.

Credentials: To subscribe to the newsletter, you must enter your email address. Optionally, we kindly ask you to provide your first and last name for your address in the newsletter. The sending of the newsletter and the associated performance measurement are based on your consent. 13.1 Newsletter:

– Service Provider
The newsletters will be sent using software or a selected email service provider based on our legitimate interests. The service provider may use recipient data in pseudonymous form, without assigning it to a user, to optimize or improve their services, for the technical optimization of newsletter delivery and presentation, or statistical purposes. However, the service provider does not use the recipients’ data from our newsletter to contact them directly or to transmit the data to third parties.

– Success Measurement
The newsletter includes a web beacon, a pixel-sized file that is retrieved from our server when the newsletter is opened or from your server in the case of using an email service provider. As part of this retrieval, technical information such as browser and system information, IP address, and the time of retrieval will be collected. This information is intended to improve the technical performance of the service based on technical data or target groups and their reading behavior based on their retrieval locations (which can be determined using the IP address) or access times. Similarly, it is determined whether the newsletters are opened and which links are clicked. For technical reasons, this information may be assigned to individual recipients of the newsletter. This is based on recognizing the reading habits of our users and tailoring our content to them or sending them different content based on their interests.

14. Payment Transactions
For a contract in which you need to make a payment, such as purchases or order registrations through eGamingUp, we require your credit card information (such as credit card number, country, credit card holder, etc.), credit card verification code (CVV), and credit card expiration date), your name, bank account number, and bank code if you choose direct debit with CLABE (international bank account number), and your address. Please note that your credit card details or payments through PayPal or other electronic means are collected and processed by your payment processor about your payments for the service.

15. Social Media
We maintain an online presence on social media platforms to communicate with customers and active users and inform them about our services. When accessing these respective networks and platforms, the terms and conditions and data processing guidelines of their respective operators apply. Unless stated otherwise in our Privacy Policy, user data will be processed whenever they communicate with us within social media and platforms, for example, when they write posts about our online presence or send us messages.

16. Integration of Third-Party Services and Content
Based on our legitimate interests (including but not limited to the interest in the analysis, optimization, and economic operation of our online offering), we use content or services provided by external providers to provide their content and services, such as including videos, images, text, links, or any physical, digital, and/or virtual materials (hereinafter collectively referred to as “Content”). This always presupposes that the providers of this content perceive the user’s IP address, as they cannot send the content to their browser without the IP address. Therefore, the IP address is required for the presentation of this content. We strive to use only content whose respective providers use the IP address solely for the delivery of the content. Third parties may also use so-called pixel tags (invisible graphics, also known as “web beacons”) for statistical or marketing purposes. Pixel tags can be used to evaluate information such as visitor traffic on the pages of this website. The pseudonymous information may also be stored in cookies on the user’s device and may include, among other things, technical information about the browser and operating system, referring websites, time of visit, and other information about the use of our online offering.

16.2 Facebook
We also use social plugins (“plugins”) from the social network facebook.com, which is provided by Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”), based on our legitimate interests. The plugins can represent elements or content for interaction (e.g., videos, graphics, or text contributions) and can be recognized by one of the Facebook logos (a white “f” on a blue tile or other variations of colors determined by Facebook, the terms “Like,” “Share” or a thumbs-up sign). They may also be marked with the addition “Facebook Social Plugin.” The list and appearance of Facebook’s social plugins can be viewed here: https://developers.facebook.com/docs/plugins/. Facebook is certified under the Privacy Shield agreement, which provides a guarantee of compliance with privacy legislation. When a user invokes the function that contains such a plugin, their device establishes a direct connection to Facebook’s servers. Facebook transmits the content of the plugin directly to the user’s device and incorporates it into the online offering. User profiles can be created from the processed data in this process. We have no control over the amount of data Facebook collects using this plugin. By integrating the plugins, Facebook receives information that a user has accessed the corresponding page of the online offering. If a user is a Facebook member and does not want Facebook to collect data about them through this online offering and link it to their stored Facebook member data, they must log out of Facebook and delete their cookies before using our online offering. 16.3 Twitter
The features of the Twitter service are included on our pages (Twitter, Inc. 1355 Market St, Suite 900, San Francisco, CA 94103, USA). By clicking on the Twitter button and using its functions such as “Re-Tweet,” among others, the websites you visit are linked to your Twitter account and shared with other users. This data is also transmitted to Twitter. We would like to point out that, as the providers of the web pages, we do not know the content of the transmitted data and its use by Twitter. 16.4 Instagram
Our online offering includes features and content from the Instagram service offered by Instagram Inc., 1601 Willow Road, Menlo Park, CA, 94025, USA. For this purpose, content such as images, videos, or text and buttons that users use to promote our content, subscribe to content creators, or subscribe to our posts may be included. If users are members of the Instagram platform, Instagram can associate or link content and functions to their user profiles there. 16.5. Reddit
On our pages, we integrate plugins from the social network Reddit (Reddit Inc., 520 Third Street, Suite 305, San Francisco, CA 94107, USA). Reddit plugins can be recognized by the orange Reddit smiley logo on our site. If you click the Reddit Share button while logged into your Reddit account, you can link the content of our pages to your Reddit profile. This allows Reddit to associate your visit to our pages with your user account. We would like to point out that, as the provider of the pages, we do not know the content of the transmitted data and its use by Reddit. 16.8. Payment provider
We make use of different payment providers integrated into our pages. We would like to point out that as the providers of the pages, we do not know the content of the data transmitted and its use by the payment providers. It is the user’s responsibility, when making a payment, to verify the privacy policy of the selected payment provider.

16.9. Amazon
Contents of Amazon (Amazon Corporate Headquarters address is 410 Terry Ave N, Seattle 98109, WA.) are integrated into our pages. If you do not want Amazon to associate visits to our pages with your Amazon user account, please log out of your Amazon user account beforehand.

17. Raffles
We will collect, process, and use personal data as organizers of the raffles, to the extent necessary to justify the legal relationship with you as a participant and for the subsequent implementation and processing. If we use a service provider for the management and data transmission of the raffle, their privacy policy will be attached to the raffle pages. To participate in the contests, we require the following personal data (e.g., your name, physical address, email, and other information that we determine to be relevant based on our legitimate interests). If you win, we will require proof of identity, residence, address, and any other necessary documents determined according to our legitimate interests. If the prize delivery is handled by third parties (cooperating partner of eGamingUp), we will provide the contact details of the winner to the respective cooperating partner, so they can get in touch with the winner.

18. Use of Pixels:
eGamingUp collects and processes technical information related to you to display personalized advertisements. For this purpose, tracking pixels are used to analyze browsing behavior and, therefore, the interests of users. This data is used to offer targeted advertising that best suits the users’ interests. Through pixels and the use of our website, your usage data (including your IP address) is transmitted and stored by a server. This includes, for example, page views and possible search queries. You can object to the use of your data by our websites and apps by using third-party tools such as ad blockers.

19. Anti Cheats-Hacks Software and eGamingUp apps
We require certain information regarding your computer, Mac, laptop, mobile, console, and the software it contains for the effective operation of our services. By installing our app and Anti-Hacks and Cheat Software (“Clients”), you agree to the collection and analysis of information from your devices that we reasonably deem necessary to identify and prevent the use of cheat software, and files used to gain an unfair advantage and enforce prohibitions. This information collection is not limited strictly to when you log into the Clients. The analyzed or collected information by the Clients may include but is not limited to, hardware, network, and software identifiers; program execution; system configuration information; files or data suspected to be used for cheating or gaining an unfair advantage. After uninstalling the Clients, no further data will be collected.

20. Information about Your Rights:
You can always request free of charge what personal data we have stored about you. If your data is incorrect, we hope to correct it. Please inform us if your data has changed.
